\u0421 using<\/a> of the www.byhillview.com website, any menu, category or sub-category, section or subsection thereof, as well as by the creation, development and termination of any legal relationship arising from the use of this website, you grant your consent to be bound by these General Terms and Conditions of Use of the website, as well as by any other terms and conditions governing individual legal relationships conditioned by its use. Under the circumstances set out in the preceding sentence, you also grant your consent to the collection and use for the purposes of the website and the legal relationships governed by it of the personal information you provide. The General and Profile Terms and Conditions apply to the current configuration of the website as well as to any changes made to it in the form of additions and modifications or the introduction of new menus, categories, sections, etc. If you do not agree to the foregoing or do not wish to provide your consent to be bound by the Terms and Conditions or the Special Terms and Conditions of the Website, you are not permitted to visit, use or be a party to any legal relationship contingent thereon.<\/span><\/p>

These General Terms and Conditions constitute a contract for the provision by HIL VIL VELIKO TURNOVO Ltd. of its own Internet site www.byhillview.com, for the performance of distance trading with gift vouchers<\/a> with potential buyers-consumers, and govern the rights and obligations of users of the website www.byhillview.com, owned by Hill Village Veliko Tarnovo Ltd.<\/span><\/p>

2). Parties to this contract are \"Hill Village Veliko Tarnovo\" Ltd - a company registered in the territory of the Republic of Bulgaria, with registered office and management address. \"Veliko Tarnovo, 5000, Magistralna str. \"8 Magistralna Street, UIC BG205040096, tel. +359 889 706 082 and email: office@byhillview.com on the one hand and any user who loads the website www.byhillview.com on the other.<\/span><\/p>

3). The user declares that he\/she is aware of these terms of use, and any active action on his\/her part, or maintaining a passive behavior once the www.byhillview.com website is loaded in the browser, constitutes an electronic declaration that he\/she agrees to these terms of use.<\/span><\/p>

4). An active action is clicking\/clicking\/selecting an electronic link or an advertising banner that takes the user to other web pages on the site. www.byhillview.com<\/a><\/span><\/p>

5). Maintaining passive behaviour means not leaving the site once it has loaded in the user's browser.<\/span><\/p>

II. Clarification of certain terms<\/b><\/h6>
Users state that they are familiar with and agree to the definitions of the following terms:<\/span><\/h6>
  1. An IP Address (\"IP address\") is a unique identification number that associates a computer, web page, or resource with a user in a way that allows it to be located on the global Internet.<\/span><\/li>
  2. Advance payment is a way of payment for the goods \/ services ordered by the User by transferring funds to the account of \"Hill Village Veliko Tarnovo\" Ltd. before receiving the ordered goods \/ services.<\/span><\/li>
  3. Browser - a computer program providing the ability to transfer, process, and display data using various types of data transfer protocols.<\/span><\/li>
  4. The visual representation of the services\/commodities (photos) on www.byhillview.com only shows the type of activity that is offered by the service provider and does not represent the actual performance of the service by the provider. There may be discrepancies between the service delivery, location of offering, type of equipment, etc. for which www.byhillview.com is not responsible.<\/span><\/li>
  5. Deposit<\/span> shall mean the amount which the RENTER\/Renter\/Client shall leave in favor of the LESSOR prior to the commencement of the rental period as security for the proper use of the rented vehicle. The LESSOR undertakes that the amount left as deposit shall be fully refunded to the RENTER\/CUSTOMER to a bank account nominated by the RENTER\/CUSTOMER or in cash within 5 working days of completion\/termination of the Contract in the event that no marks, damages or the like resulting from the improper or misuse of the vehicle are found after the return of the vehicle to the LESSOR. In the event that there are damages to the vehicle resulting from improper and\/or bad use during the rental period, the deposit left shall not be returned to the USER but shall remain in the LESSOR's patrimony, and in the event that the damages caused exceed the amount of the deposit paid, the LESSOR shall be entitled to claim additional payment for the costs incurred in repairing the damages and damages caused, as well as the penalties due in accordance with Annex 1.\u00a0\u00a0<\/span><\/li>
  6. Rental Vehicle Driving Instructions means training materials prepared in advance by HIL VIL VELIKO TURNOVO, which are provided to the RENTER\/USER immediately after payment for the service for free use of the rental vehicle and with which the RENTER\/USER is REQUIRED to familiarize himself\/herself before driving the rental vehicle.\u00a0<\/span><\/li>
  7. Remote rental is a service offered by HIL VIL VELIKO TURNOVO, where the rented vehicle is not located in the base of the LESSOR and there is no representative of the Company at the beginning of the contract (start of the rental period). In this case, the necessary documents, vehicle keys, etc. shall be provided to the RENTER\/USER by a person designated in advance by HILL VIL V. Tarnovo or in the manner mentioned in the confirmation email sent to the USER or in the manner described in the USER's personal profile. Prior to the start of the use of the vehicle, the USER is obliged to send a photo to the LENDER, from which the current condition of the rented machine is clearly visible. In the event that this obligation is not complied with, any damage or breakages to the vehicle will be deemed to have been caused by the USER failing to send the photographs.<\/span><\/li>
  8. A distance contract is any contract concluded between a trader and a consumer as part of an organised distance selling system or the provision of services at a distance without the simultaneous physical presence of the trader and the user, through the exclusive use of one or more means of distance communication, up to and including the conclusion of the contract. This is the contract for the use of the vehicle, which is concluded between HIL VIL VELIKO TURNOVO Ltd. and the USER\/RENTER at the time of booking via the Vehicle Rental Website.<\/span><\/li>
  9. An electronic link is a link identified in a particular web page that allows automated reference to another web page, information resource or object through standardised protocols.<\/span><\/li>
  10. Malicious acts are acts or omissions that violate Internet etiquette or harm persons connected to the Internet or associated networks, sending unsolicited commercial messages (SPAM), gaining access to resources with someone else's rights and passwords, exploiting flaws in systems for personal gain or to obtain information (HACK), committing acts that may qualify as industrial espionage or sabotage, damaging or destroying systems or information arrays (CRACK), sending Trojan horses or causing the installation of viruses or remote control systems, interfering with the normal operation of other users of the Internet and associated networks, committing any act that may qualify as a criminal offence or administrative offence under Bulgarian law or other applicable law.<\/span><\/li>
  11. A website\/shop is a collection of websites with a common homepage that loads in your browser when you type in the email address www.byhillview.com<\/span>;<\/span><\/li>
  12. Website for the purposes of these Terms and Conditions means a component and separate part of a website.<\/span><\/li>
  13. Interface - a combination of graphical objects associated with programming code, through which the user communicates with the website in a way that is accessible to him.<\/span><\/li>
  14. An Information System\/System is any single device or collection of interrelated or similar devices that, in the execution of a specific program, provides automatic data processing.<\/span><\/li>
  15. The description of services\/goods on www.byhillview.com includes information about the service\/good provided by the specific provider. There may be a discrepancy between the service description and its performance, depending on unforeseen circumstances, adverse weather conditions or otherwise, for which www.byhillview.com is not responsible.<\/span>
    <\/span>Merchant is the owner of the online store www.byhillview.com - \"Hill Village Veliko Tarnovo\" Ltd, with registered office and management address in Veliko Tarnovo 5000, ul. \"Magistralna\" \u2116 8.<\/span><\/li>
  16. A password is a code of letters, numbers and characters that, together with the username, individualizes the user and that, together with the username, is used to access the user's profile.<\/span><\/li>
  17. Platform - a set of conceptual, programmatic and graphic solutions, constituting a complete product providing the user with an accessible environment to the possibilities of the Internet space.<\/span><\/li>
  18. Gift voucher - a document issued by the merchant, which the user\/customer receives electronically or on paper and which certifies that the user\/customer has paid for the advertised goods or services in full or in part and can therefore benefit from it. The gift voucher issued by Hill Village Veliko Tarnovo Ltd. is not a means of payment, cannot be used as such and cannot be exchanged for its cash equivalent. It only certifies that a payment has been made for a certain package including goods or services for which the document has been issued. This document will be referred to hereafter as the contract of sale.<\/span><\/li>
  19. An order is a request for the purchase of goods\/services from the website under the terms and conditions set out therein regarding the method of delivery and payment by the user\/customer.<\/span><\/li>
  20. A user\/customer of a website or site is any person (potential buyer of the offers) who has entered the e-mail address or reached the website or site by redirection from another Internet site and agrees, if interested, to purchase goods and\/or services electronically;<\/span><\/li>

  22. A username is a unique code of letters, numbers and symbols chosen by the user, by means of which the user identifies himself in his relationship with the Contractor;<\/span><\/li>
  23. Remote Hire Booking means the entire process of hiring the vehicle remotely by entering into a remote contract, which includes placing the order for the hire of the vehicle online, selecting the hire period, completing the online order by confirming the terms of use of the vehicle, the terms and conditions, the terms of the contract between the parties and making the necessary payments. Proof of the available reservation is the contract concluded between the parties for the use of the vehicle, which the LENDER undertakes to send to the USER electronically. In case the USER wants the concluded contract to be sent on paper, he\/she shall inform the LESSOR thereof.<\/span><\/li>
  24. Booking on request means the process of booking a specific date and time for the organization of any of the services offered by \"Hill Village Veliko Tarnovo\" Ltd. on its website www.byhillview.com.<\/span> or with its partners. In this booking process, the USER, through a specially built automated booking system, requests a reservation for an order already placed by him, through the website www.byhillview.com.<\/span>\u00a0or other affiliate of HILL VILEKO TURNOVO SITE, which is subsequently confirmed\/rejected or denied by HILL VIL.<\/span><\/li>
  25. An accidental event is a circumstance of an extraordinary nature, unforeseen at the time of conclusion of the contract, which makes the provision of the services objectively impossible.<\/span><\/li>
  26. A website (\"website\") is a distinct location on the World Wide Web that is accessible via its Uniform Resource Locator (URL) using HTTP, HTTPS or other standardized protocol and contains files, programs, text, sound, picture, image or other materials and resources.<\/span><\/li>
  27. A service is any action by \"Hill Village Veliko Tarnovo\" Ltd. in connection with an order placed by a user\/customer regarding the products offered on the online store.<\/span><\/li><\/ol>


    In addition to the aforementioned terms, the users declare that they are familiar with all further defined terms in the Rules for the Use of Vehicles, which are an integral part of the General Terms and Conditions of HIL VELIKO TURNOVO Ltd. Terms not included in these General Terms and Conditions, the Vehicle Use Rules or the Vehicle Use Contract shall be deemed to be understood according to their ordinary meaning.<\/span><\/p>

    III. Subject matter of the contract<\/b>.<\/span><\/h6>
    1. \"Hill Village Veliko Tarnovo\" Ltd. provides for the use of users an online shopping platform, through its website www.byhillview.com, under the terms of a distance sales contract within the meaning of Article 45 et seq. of the Consumer Protection Act, exercising the powers granted to it under this contract.<\/span><\/li>
    2. \"<\/span>Hill Village Veliko Tarnovo Ltd. also provides consumers with the opportunity to conclude contracts remotely through the company's website. Such contracts are concluded not only for the sale of a specific service but also for the temporary provision of the use of vehicles (rental of vehicles for short periods). <\/span>
      <\/span>The Distance Selling Contract, through which the user purchases goods\/services using the platform provided by Hill Village Veliko Tarnovo Ltd, as well as the Vehicle Use Contract, concluded remotely, are distinct from these General Terms and Conditions and the Vehicle Use Rules, and by making an electronic statement to conclude the Vehicle Purchase and Rental Contract, the user\/lessee agrees to both these General Terms and Conditions and the Vehicle Use Rules.<\/span> \"Hill Village Veliko Tarnovo Ltd shall not be liable in the following cases:<\/span><\/li><\/ol>

      - For damage caused by other sites accessible via links\/banners placed on this site;<\/span><\/p>

      - For any defects and\/or other claims liability in respect of the services\/goods purchased by the user through www.byhillview.com, and if the terms and conditions advertised on the site prove to be incorrect or misleading;<\/span><\/p>

      - For the quality of the goods or services provided or purchased from the site. Any issues arising in this regard shall be resolved between the user and the supplier who provided the specific goods or services.<\/span><\/p>

      - For violation of copyright and related rights through the placement of materials subject to these rights, provided by third parties promoting through the website owned by \"Hill Village Veliko Tarnovo\" Ltd.;<\/span><\/p>

      - For any damage caused to users in the provision of the service;<\/span><\/p>

      - If the user forgets his account logged on a computer or in any other way permits and\/or allows it to be used by third parties who have abused his registration;<\/span><\/p>

      - For damages caused by lack of or interruption of accessibility to the website www.byhillview.com, not attributable to the team of the same.<\/span>The username with which the user registers does not give the user any rights other than the right to use the specific username within the information system of Hill Village Veliko Tarnovo Ltd. When the user changes his\/her username, \"Hill Vill Veliko Tarnovo\" Ltd. does not verify and is not responsible for the authenticity of the new username, whether it affects the rights of third parties and in particular the right to a name or other personal rights, the right to a trade name (company), the right to a trademark or other intellectual property rights.<\/span><\/p>

The User undertakes to comply with the Bulgarian legislation, applicable foreign laws, these General Terms and Conditions when using the access to the electronic platform provided to him, <\/span>The rules for the use of the vehicles, Instructions for driving the hired vehicles, <\/span>Internet ethics, the rules of morality and good manners; not to harm the good name of another and not to call for a violent change of the constitutionally established order, to commit a crime, to violence against the person or to incite racial, national, ethnic or religious hatred, not to preach fascist or other anti-democratic ideology, not to violate other people's property or moral rights, including intellectual property rights; immediately notify \"Hill Village Veliko Tarnovo\" Ltd. of any violation committed or detected; not to interfere with the proper functioning of the system, including, but not limited to, not to frustrate the identification procedure of another user, not to perform access beyond that granted, not to impair or hinder the availability, reliability or quality of the access granted, and not to use it in a way that causes its use to be denied; not to extract, by technical means or in a technical way, information resources or parts of information resources belonging to the databases located on the website of Hill Vill Veliko Tarnovo Ltd.<\/span><\/p>

      \u00a0 \u00a0 \u00a04. Except where expressly agreed, the user may not reproduce, modify, delete, publish, distribute or otherwise disclose the information resources published on the website of Hill Village Veliko Tarnovo Ltd..<\/span><\/p>

      IV. Protection of personal data<\/b><\/h6>
      1. \u00a0\"Hill Village Veliko Tarnovo\" Ltd. takes due care and is responsible for the protection of the user's information, which has become known to him on the occasion of the registration - subject to these Terms and Conditions, except in cases of force majeure, accidental event or malicious acts of third parties. \"Hill Village Veliko Tarnovo Ltd collects and processes information about Users solely for the purposes set out in these Terms and Conditions and the Personal Data Policy.<\/span><\/li>
      2. \u00a0In the registration form, filled in by the user at registration, \"Hill Village Veliko Tarnovo\" Ltd. indicates the mandatory or voluntary nature of the provision of data and the consequences of refusal to provide them. By agreeing to these General Terms and Conditions, the Vehicle Use Policy and the Personal Data Policy, the user agrees to the processing of his\/her information in the manner provided for therein. The user profile created upon initial registration has default settings allowing free access to the personal data declared by the user. After registration, if desired, the user has the right and the technical possibility, by changing the default settings, to restrict or prohibit access to their personal data.<\/span><\/li>
      3. When making any reservation for the temporary use of a vehicle, as well as for the purchase and sale of any of the services offered, the user\/renter\/customer once again declares his consent to the provision of his personal data by noting that he has read the Declaration on the provision of personal data.\u00a0<\/span><\/li>
      4. The limitations under paragraph 1 shall not apply in the event that the user or persons under his control have committed malicious acts within the meaning of these Terms and Conditions or have violated the rights or legitimate interests of third parties. In this case, \"Hill Village Veliko Tarnovo\" Ltd. has the right to provide the personal information of the user to the relevant competent state authorities in accordance with the legislation in force.<\/span><\/li>
      5. \"Hill Village Veliko Tarnovo\" Ltd. collects and uses information about users only for the purposes set out in these Terms and Conditions. The described purposes for which the information is used are not exhaustively listed and do not give rise to any obligations for Hill Vill Veliko Tarnovo Ltd.<\/span><\/li>
      6. By accepting these General Terms and Conditions, the user agrees to the processing of his personal data for the purposes of the contract for the purchase and sale of promoted goods, concluded at a distance, by consenting to advance payment.<\/span><\/li>
      7. With the adoption of <\/span>General Conditions and Rules for the Use of Vehicles, n<\/span>the user agrees that his\/her personal data, declared as publicly available in his\/her user profile at www.byhillview.com; the information about the user's friends in these user profiles; the photos or text materials uploaded in the profiles, or similar, may be used and distributed by \"Hill Village Veliko Tarnovo\" Ltd. for direct marketing purposes, unless he\/she explicitly prohibits access to them. The user's actions on www.byhillview.com (products liked, questions asked, comments, making friends) and information about the goods\/services purchased (number, price, specifics) may be used by \"Hill Vill Veliko Tarnovo\" Ltd. for direct marketing purposes.<\/span><\/li>
      8. \"Hill Village Veliko Tarnovo\" Ltd. undertakes not to disclose any personal information about the user and not to provide the collected information to third parties - state authorities, commercial companies, individuals and others, except in cases when:<\/span><\/li><\/ol>

        - has obtained the user's explicit consent at registration or at a later time;<\/span><\/p>

        - the information has been requested by state authorities or officials who are authorised under the applicable legislation to request and collect such information in accordance with the procedures established by law;<\/span><\/p>

        - other cases specified in the law.<\/span><\/p>

By agreeing to the terms and conditions of www.byhillview.com<\/span>, the user allows in his user profiles www.byhillview.com<\/span>\u00a0or to the e-mail address and mobile phone number provided by him\/her, to be sent personal, advertising or other commercial messages by \"Hill Village Veliko Tarnovo\" Ltd. or by the merchants bidding on the site.<\/span><\/p>

        \u00a0 \u00a0 V.\u00a0<\/strong><\/span>Technical clarifications<\/b><\/h6>

        \u00a0 \u00a0 1. Clarification of the technical steps by a consumer-buyer in concluding a contract for the purchase and\/or use of a vehicle remotely via the website www.byhillview.com<\/span><\/b><\/p>

        1). By loading the homepage www.byhillview.com, the user gets the opportunity to get acquainted in detail with a published offer, which in most cases refers to the purchase and sale of the offered product\/service. In a prominent place, the user can get acquainted both with the data of the company, owner of the website and the General Terms and Conditions of Use of the website.<\/span><\/p>

        2). By making an active action - selecting a link, banner, active button or picture, the user declares that he\/she is familiar with the Terms and Conditions of use of the site.<\/span><\/p>

        3). In case the user has the will to conclude a contract through the platform provided to him, he should reach a page - part of the website containing a specially designed interface through which the user will make the electronic expression of will to conclude a distance purchase contract. The purchase of a service\/good from the website www.byhillview.com can be made by a registered and a non-registered user who, in accordance with these General Terms and Conditions, provides the data necessary for the conclusion and performance of the contract.<\/span><\/p>

        4). The user-buyer, after reading the General Terms and Conditions and the text of the purchase contract, should be aware that the purchase contract is not concluded with the owner of the site, but with an explicitly mentioned third party, which is announced after placing an order. The trader is also a user of the www.byhillview.com website, using the electronic platform provided for distance shopping and promotion of the goods\/services he offers.<\/span><\/p>

        5). The payment of the contract price is made by means listed exhaustively on the site, the payment being on the one hand a voluntary statement of the user that he agrees to pay for the service, on the other hand an electronic declaration by the user that he agrees to the General Terms and Conditions of Use of the site and the conditions of purchase and sale, which he has read, approved and chosen to date.<\/span><\/p>

        6). After the conclusion of the contract, the user receives a message at the email address provided during registration, for the successful acceptance of his electronic will, which is a confirmation that the contract is concluded. From there on, the parties to the contract are governed according to the General Terms and Conditions.<\/span><\/p>

        7). Any change in the circumstances of the contract shall be communicated to the user by sending an e-mail to the e-mail address provided during registration. Transfers of money from www.byhillview.com to users of the site are made by bank transfer only, and any transaction costs incurred in connection with the amount transferred are the responsibility of the user receiving it.<\/span><\/p>

        VI. Order, <\/b>remote reservation<\/b>, reservation on order payment and delivery<\/b><\/b><\/h6>
        1. Order:<\/span><\/li><\/ol>

          1.1. Orders for gift vouchers from www.byhillview.com are accepted and processed every working day from 09:00 to 18:00. Users are also notified by e-mail of the receipt and confirmation of orders from www.byhillview.com<\/span>.<\/span><\/p>

          1.2.Each order shall include the following mandatory elements: order number; products ordered, number, unit price and total value; gift voucher type and value; payment method; total order price; delivery address.<\/span><\/p>

          1.3.The final price of the order is calculated as the sum of the prices of the ordered services. All prices in the online store www.byhillview.com are in Bulgarian leva including VAT. The prices of the products do not include the price of the paper gift voucher and its delivery.<\/span><\/p>

          1.4. The gift voucher of \"Hill Village Veliko Tarnovo\" Ltd. is offered in 2 variants - electronic gift voucher and paper gift voucher.<\/span><\/p>

          1. Reservation for remote rentals:<\/span><\/li><\/ol>

            2.1. The reservation in case of remote rental is the completed order for the service of independent vehicle rental, which HIL VIL VELIKO TURNOVO Ltd. provides to its users. Through the company's website, users can request the independent use of any of the specified vehicles.\u00a0<\/span><\/p>

            2.2. When making this type of order, a reservation is made, which is completed by making a certain payment for the service specified in the price list, together with all fees and taxes included therein, as well as by signing a distance contract for the use of a vehicle. Completion of the booking process is characterised by the sending to the hirer of the contract for the use of the vehicle specified by the parties at a distance.\u00a0<\/span><\/p>

            2.3. Upon making a reservation prior to the start of the rental session, the renter is required to pay a deposit in favor of the lessor, which shall be refundable to the renter upon completion of the contract in the event that there is no damage to the rented vehicle. In the cases set out in the Vehicle Rules, the deposit left shall not be refundable.\u00a0<\/span><\/p>

            2.4.Each reservation includes the following elements: renter\/user, rented vehicle, duration of the rental session, location from which the vehicle will be picked up (rental session will start), return area of the rented vehicle, price of the service and amount of the deposit due.<\/span><\/p>

            2.5.All prices in the online shop www.byhillview.com for the provision of the use of the vehicles are in Bulgarian levs including VAT.<\/span><\/p>

            2.6. In the case of a distance contract for the use of the vehicles, Hill Village Veliko Tarnovo Ltd. offers two options for delivering the contract - electronically via the email address provided by the renter\/user or sent on paper at the expense of the user\/renter.<\/span><\/p>

            1. Reservation on request of any of the services offered by the website www.byhillview.com<\/span>\u00a0or its partners<\/span><\/li><\/ol>
              1. Payment methods:<\/b><\/li><\/ol>
